Is it possible to thunder behind bars if one cartridge is found at home

Despite the fact that a lot of time has passed, the "echo of war" (and more than one) continues to spread over the vast Fatherland. Here and there, citizens find ammunition for a variety of weapons. Some enthusiasts decide that it would be okay if they take one of these "toys" to their home. Hence the question: is it possible to "go to prison" for just one unfortunate patron at home in a service?

There are two main laws regarding the storage of ammunition in Russia. The first is Article 222 of the Criminal Code of the Russian Federation. The second is Article 20.8 of the Code of Administrative Offenses. Which article will apply to a citizen who incorrectly or illegally stores ammunition for weapons is determined by what kind of cartridges they were.

So, improper storage of ammunition for weapons of limited destruction (smooth-bore rifle cartridges) will most likely be subject to an administrative article. At the same time, storage of ammunition for rifled weapons, with rare exceptions, will be held in court under a criminal article. Accordingly, the severity of the punishment will also vary greatly depending on the specific legal process and the article imputed to the citizen.

Article 222 of the Criminal Code of the Russian Federation directly states that the law of the country provides for punishment for illegal storage of ammunition. At the same time, from the point of view of the law, there is no difference whether one cartridge was found on a person or a whole store with ammunition was found. Purely theoretically, a citizen has some chances to convince the court that 1-5 cartridges "for memory" are "minor actions" taking place in accordance with Part 2 of Article 14 of the Criminal Code of the Russian Federation.

In practice, the courts astronomically rarely take the side of citizens in matters related to weapons and illegal storage of ammunition. It is almost impossible to convince the court that you were not going to use the cartridges in any way. This is evidenced by the available statistics of similar court cases to date. As a rule, decisions are made in favor of the state prosecution, so that even for one cartridge you can completely go to jail or (more likely, but if there was only one patron) receive a suspended sentence, which also does not add joy in life.

So it is best not to touch any cartridges with your hands, and even more so not to carry them to your house. And in general, not from your weapons and ammunition should be kept as far as possible. If something like that was suddenly found, for example, at a summer cottage, it is necessary to report the find to the police and the Ministry of Emergency Situations.
