A bathhouse building permit is mandatory document, which the future owner of the building receives before the start of work. The presence of a permit gives the right to register a bathhouse as real estate in the future. Ignoring this operation leads to problems with the law and even the demolition of the building.
When you need permission
The question of whether a bath is subject to state registration depends on the type of object. If the bathhouse is portable or a barrel, then the entry of such an object into the register is optional. Those baths that are attached to the house are not subject to registration. If we mean a capital construction that has all the features of real estate, then it needs registration (in accordance with article 51, clause 17 of the Civil Code of the Russian Federation).
According to the Civil Code of the Russian Federation, there is a simple way to determine whether a bath has properties of real estate. Property has two parameters:
- strong connection with the ground;
- the inability to separate the building from the ground without much damage.
The law does not have unambiguous guidelines for baths. Therefore, if the owner of the steam room has questions about the need to obtain permission, he can ask the employees of the municipal authorities at the place of registration.
Package of documents
To obtain permission to build a bath, a citizen applies to the appropriate civil service (in different regions this task is performed by different departments). The owner of the bath passes the following set of documents to the civil service employees:
- a statement in which the address of the land plot and building is recorded;
- site owner's passport;
- a document that secures the ownership of the site;
- design documentation for the bath (all those are indicated. characteristics - construction category, number of premises, heating equipment, etc.);
- a list of communications connected to the bath + a diagram of the drainage system and drainage system.
Bath requirements
Registration of a bath is carried out only if the building meets the requirements, which are divided into two groups:
- sanitary standards;
- fire safety standards.
Detailed information about the sanitary standards in relation to the bath is contained in the SNiP. Standard building requirements include:
- distance to neighboring buildings (the gap between the bathhouse and the residential building is at least 5 meters);
- distance to reservoirs (the bath is separated from reservoirs by 20 meters and more - to avoid flooding);
- the distance to the neighboring site (the gap between the bathhouse and the neighbor's territory is from 3 meters).
- visibility: the bathhouse must be visible through the window of the residential building of the owner of the site.
Fire safety regulations place a large number of requirements on steam rooms. The list of main points includes:
- the area and height of the steam room;
- number of floors and the presence of a separate exit;
- the quality of the interior decoration of the bath (the steam room must be finished with fire-fighting materials);
- the degree of protection of the furnace (normally the furnace is fenced off from the steam room space with the help of metal screens);
- uninterrupted operation of supply and exhaust ventilation.
