I think everyone at least once, but noticed, not in his own, so in other people's yards, as there is some kind of wreck, rots from old age or from the fact that the locals completely bare her, removed almost everything that could be take off.
As such, abandoned cars stand for many years, occupy parking spaces and create all kinds of inconveniences.
In fact, abandoned cars are a problem for any metropolis, but I can't understand, does the authorities need to make a lot of efforts to clear the streets of junk?
Parents live in one of these courtyards and I come to visit them a couple of times a month and I constantly face the problem that there is no place to park. And not one, but two such cars, in which homeless people spend the night, take up space there. Nobody kicks them out of there, so they are nobody's?
I am engaged in construction and a couple of years ago I met a man who owns a small Chinese manipulator and the idea arose why not load and hand over this junk for scrap.
I called Kolya (Nikolai Petrovich), explained the situation, he, in turn, talked to his people, calls back and says:
- Dear friend, I talked to my friends and I do not advise doing this, it may end in a criminal case even though the car has no state numbers. They were simply removed, but the car is still owned.
- I understand that, but the owner has not appeared for 7 years already.
- Look for yourself, but it can be either a stolen car or a person in prison. In both cases, there is a chance that someday there will be an owner.
But, I did not stop there and consulted with a lawyer ...
Here's what I learned:
Rotting this car for the rest of its life, if the car owner does not show up or change the laws. Because local government officials need to recognize the vehicle as rubbish, deregister it and evacuate it. But, this chain is complicated, since registration is removed at the request of the owner, the rest of the loopholes in the laws are based on bird rights.
Of course, there are norms according to which such cars are activated by the commission as ownerless, but as in any laws, there are nuances. Even if there are no license plates, this does not mean at all that they are not. If the car is not removed from the register, then it is someone's property. The administration won't do anything with him, period.
Therefore, an abandoned car without license plates is not always ownerless, and even if the owner is not found or unknown - independent evacuation actions are prohibited and this will be regarded as theft t / s.
In fact, the problem of such vehicles has not been settled in our country and the administration also does not need problems with the owners of such cars, because such vehicles can sue for compensation from the local budget.
99% of such junk is someone's property, it's just that evacuation is more expensive than the cost of the car itself.
