We are looking for the owner of an empty land

The fact that no one looks after the land does not at all mean that it has no owner. It may be a private person no longer interested in the territory; an organization that has no need to sell a site yet, but it is a pity to sell, or a municipality.

Get a cadastral number by which you can order an extract from Rosreestr, where the owner will be indicated. If there is no information about the owner in the statement, then it is so old that it did not get into the electronic databases. Make a request to your local archive. Is the owner an individual? So you need to contact him and resolve all controversial issues. If the owner is not listed at all in the statement, go to the local administration.

Obligations in relation to the land plot

All legal relations concerning land plots are governed by Art. 209 and Art. 210 of the Civil Code of the Russian Federation. Each allotment has an affiliation and purpose, according to which the owner must use them. In addition, together with the site, the owner receives obligations to pay taxes, to register the real estate objects located on it, for paying for housing and communal services and maintaining the territory in proper condition.

If the owner has been using the land for more than three years, it can be withdrawn. This measure has been in effect since 2018, and so far few have taken advantage of it. Owners who do not use their property at all fall under the same article, however, the period of desolation should be at least five years.

What is the penalty for non-use of land

For violation of the purpose of use or non-use of a land plot, the landowner faces a fine, the amount of which starts from 20,000 rubles and depends on the cadastral value of the object.

If the adjacent area is overgrown with weeds; intended for individual housing construction, but no one is being built; there is no economic activity; has become a spontaneous dump site or is contrary to fire regulations - notify your local government. A land surveyor will go to the scene, establish the fact of the violation, and then the administrative commission will take appropriate measures against the violator.

However, if the owner of the problem area is not known, the administration will not look for him.

Is it possible to deprive the owner of a land plot

It is difficult, but not impossible. If the owner is known and does not interfere with the seizure, then the site will be sold at auction, and part of the funds will be transferred to the now former owner.

If the owner does not use the plot and does not want to give it away, then only the local self-government body can make a decision to withdraw it. The process will drag on for a long time, you cannot influence it, but do not stop reminding about the current problem.
