Life is full of paradoxes and sometimes it happens that the distance between neighboring buildings in summer cottages is correct, but construction standards are still violated. I encountered this problem, studied the solutions and now I can tell you how this can happen. Let's try to understand the difficult situation in this article.
To begin with, the owner of a summer cottage needs to know not only how to plant and weed, but also to have some understanding of certain norms that are described in the Code of Rules, in particular in clause No. 6.7 of the joint venture 53.13330. These rules apply to the planning and development of suburban areas.
In particular, it says that a distance of 3 meters must be observed from the fence separating neighboring plots to your home. To a household building not intended for keeping animals, the distance should be 1 meter.
However, this requirement has its own characteristics, non-compliance with which may lead to violation of the relevant standards. What can be a violation:
1. Erroneous measurement
The subtlety here is that it is necessary to take into account not only the distance from the basement of the building, but also such a factor as the overhang of the roof. Let the wall be at the correct distance of 3 meters, however, if the roof overhang is more than 50 cm, for example 70 cm, then the distance from the house to the fence will no longer be considered three meters, but only 2. 30. This is described in SP 53.13330.2019.
If there is also a balcony on this side of the house, then the situation is even worse. The distance will decrease by its width. This rule is triggered when the extreme point of the protrusion of the house (building) exceeds 50 cm.
2. Failure to comply with fire safety distances
During the construction of suburban facilities, it is necessary to take into account fire safety distances to nearby buildings, and if they are not standardized inside the site, but the rules still exist and are very clear.
In clause 6.5 of SP 53.13330 of the 2011 version, there is a table No. 2, which indicates all the necessary fire distances. There is no such table in the 2019 version of this document, but there is a link to table No. 1 from the Code of Rules 4.13130.2013. For ease of perception, I made my own table.
The essence of the information given here can be explained with a simple example.
Suppose that in the neighbor's dacha there is a house made of non-combustible materials belonging to category "A" at a distance of three meters (minimum indent) from the fence. You will be able to build your house with materials of the same type (category "A") directly opposite the neighbor's house only with a minimum setback of three meters. That is, the fire distance between houses must be at least six meters.
It will be impossible to build a frame house or a brick garage at a distance of one meter from the fence. The garage can be built, according to the fire regulations, offset from the fence by three meters and only if it will have category "A".
But the frame house in this case will have to be already seven meters from the fence, since such houses have flammability category "B" and, according to the joint venture, the minimum distance between structures with different categories ("A" and "AT"). should be 10 meters.
By the way, the material from which the bath or sauna is built also matters. If the fence is made of combustible material, then a distance of not one, but three meters should be observed from it to the bath.
3. Additional nuances that determine the distance from the fence to the buildings on your site
This list includes distances to water sources from neighbors and to the windows of a neighboring residential building. For baths, the drain is important, which must be built with sanitary standards, that is, placed at least three meters from the fence. If the bath has a sewer, then it can be located a meter from a fence made of non-combustible materials. The height of the bath is also important.
In order not to redo already constructed buildings, I recommend that you carefully read the regulatory documents before starting construction. And it is best to consult with architects.
