Which baths do you need to register?
The answer to the question of whether a bathhouse is subject to mandatory registration depends on its format. For example, typical ready-made baths that are brought and assembled on the site are not included in the category of significant immovable sites. Therefore, you do not need to register them. If it comes to capital construction, then it must go through the documentation.
Amendments to Law N 340-FZ, which entered into force on 03/01/2019, oblige to register baths, the area of which exceeds 50 m2. The question of which objects are considered real estate is covered in Art. 131 of the Civil Code of the Russian Federation. According to this document, two characteristics belong to real estate:
- strong connection with the ground;
- the inability to separate the object without causing significant damage.
How to register a bath
If your bath fits the definition of a real estate object, then you can register a building in any of the following ways:
- personal visit to the office of Rosreestr or the MFC;
- sending a registered letter to the address of Rosreestr;
- sending an application over the Internet - through the State Services or the Rosreestr website.
According to the law, the bath belongs to outbuildings. To enter such a building into the database, the following set of documents will be required:
- application for registration (or declaration - in case of amnesty);
- passport of the owner of the site (or his representative);
- documents confirming the right to the site (certificate of title, contract, extract from the USRN);
- boundary and technical plans for the summer cottage;
- building permit (not needed for amnesty).
The lists of documents may differ in some regions. It is recommended to check the latest information with the municipal authorities or the registration chamber of your region.
How long does registration take and what is its price
Authorized bodies register a bathhouse within 7-10 working days. At the end of the operation, the owner of the land plot is issued an extract from the USRN with updated data. Registration cost depends on the status of the bath:
- 350 rubles for plots that fell under the dacha amnesty;
- 2,000 rubles for baths that are being built with a permit.
If the owner of the bath neglects registration, then sooner or later he will have to pay a fine.
Sanctions have two components: 20% of the cumulative unpaid tax amount + payment of tax for three years. It is also important to remember that it is forbidden to alienate buildings that are not in the Rosreestr database, put them into operation and connect them to utility networks.
