Unfortunately, it is not forbidden to add soil to your site. This is used by those who, as a result, raise the ground level to 0.5-2 m in height. As a result, the flood goes to neighboring areas.
You can deal with this like this:
- Demand in writing from a neighbor to eliminate violations in the use of the site: regular flooding is a real obstacle.
- Conduct an examination.
- Go to court, referring to Art. 304 and 15 of the Civil Code of the Russian Federation.
Damage to water in the well
Wastewater and the contents of the septic tank can seep through the ground into the well.
What to do? Need to:
- Refer to sanitary standards, according to which the septic tank can be located no closer than 2 m from the fence.
- Contact Rospotrebnadzor (to which the SES is subordinate) and conduct an examination.
Landfill on the border
Waste and debris at the border of the parcels is a violation. You need to react like this:
- Contact the local administration or SNT management, fixing the violation.
- Submit a claim to the court under Art. 304 of the Civil Code of the Russian Federation.
Old car on the road
If a neighbor threw his trash on the road and is not going to clean it up, you need to do this:
- File a complaint with the administration or the traffic police.
- Go to court. This makes sense if the vehicle is obstructing the passage or driveway to your area.
Septic tank drain
Overfilled septic tanks are supposed to be pumped out and disposed of with the help of special services. If a neighbor just turned on the pump and pours fecal water into the ditch, he violates Art. 7 Federal Law "On the sanitary and epidemiological welfare of the population." Here you must immediately write a complaint to the SES.
Snow discharge
This is a trifle - but if a neighbor throws snow towards you, he violates Art. 304 of the Civil Code of the Russian Federation.
You need to act like this:
- Fix the violation in a photo or video.
- Report to the police.
Restriction of access to the reservoir
If a neighbor dug a moat so that the water would not flood his area, he violates Art. 6 VK RF. Water bodies - especially firefighters - cannot be restricted in access to them.
You can fight by filing a complaint with the municipal authorities or the prosecutor's office (especially the environmental one, if it operates in your region).
Noise at the site
Feasts, loud music, firecrackers and other noise are a violation. The specific norms are different in each region, but in any case, there is a time when it is impossible to make noise. If a neighbor violates these norms, you need to file a complaint with the police or Rospotrebnadzor, attaching an audio or video recording of a too noisy party to it.
Smoke from incineration
If smoke annoys you, then this is a violation of Art. 20.4 of the Administrative Code of the Russian Federation and fire safety standards. On them, a fire can be burned only 50 m from the house. If a neighbor commits violations, call the firefighters or file a complaint with the district police officer.
How to protect yourself from neighbors
The best way to avoid problems is to have good neighborly relations. No one demands to love your neighbors and be sincere with them, but ordinary politeness often solves a bunch of issues. Do not refuse help, be friendly and polite with your neighbors, say hello when you meet - and almost always, in response to a polite request not to violate your rights, they will meet you halfway.
If you do not like close communication, be direct about it, but emphasize that you have nothing against them specifically and ready to provide mutual services (for example, a neighbor digs a well 1 chip in to pay for work, so that you can take from there water). Mutual benefit unites.
It is necessary to go to court or the administration only in cases when there is no other way out, and the neighbor demonstratively does not understand human requests.
